In Malaysia, induced abortion is illegal under Act 574 of the Penal Code (Revised – 1997). However, an exception clause has been added to Section 312, a medical practitioner registered under the Medical Act 1971 who terminates the pregnancy of a woman if such medical practitioner is of the opinion, formed in good faith, that the continuance of the pregnancy would involve the risk to the life of the pregnant woman, or injury to the mental or physical health of the pregnant woman, greater than if the pregnancy were terminated. In addition, Section 314 indicates that if the process of termination of pregnancy results in the death of the mother, this would constitute a criminal offence (Malaysian Penal Code)(Ministry of Health, 2012)
Some legal opinions conclude that where conditions 4 and 5 exist, that is rape, incest or foetal impairment, they would also be covered by condition 3:
